THE DISTRICT PROJECT OFFICER, SARVA SIKSHA ABHIYAN (SSA),KAPDA, YSR DISTRICT. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order or direction or Writ, more particularly, one in the nature of Writ of Mandamus declaring the impugned guidelines issued by the 2nd respondent vide Proc.Rc.No.40/RVM(SSA)/IE/C5/2009 dated 27-04-2013 directing the District Project Officers, SSA to select the candidates in the posts of Inclusive Education Resource Teachers (IERTs) in IERC Cluster Mandals of the Districts in the State in the ratio of 1 : 1 (1 for MR Category . 1 for HI or VI Category) and not fixing the ratio between HI and VI Categories, irrationally and without any basis and the consequential impugned Proc.Rc.No.1581/APSSA/IE/A11/2017 dated 14.05.2018 to fill the IERT vacancies of MR Category with B.Ed., (MR)/D.Ed., (MR) qualified candidates duly replacing HI/VI category IERTs who are conditionally working in the position of MR category IERTs is irrational, without any basis, illegal and against Article 14 and 16 of the constitution of India and consequently set aside the proceedings of the 2nd respondent dated 27-04-2013 and the consequential proceedings dated 14-05-2018 and direct the respondents to allot the posts of IERTs in the Districts among MR, HI and VI category in proportion to the ratio of the MR, HI and VI children available in the respective Districts and continue the petitioners as IERTs in the VI category vacancies and pass Counsel for the Petitioner(S): 1.
