Present applicant–Paramjeet Singh is in judicial custody since 31.07.2023 and seeking bail in relation to FIR/Case Crime No.0214 of 2023, registered on the basis of FIR dated 29.07.2023 at Police Station Sitarganj, District Udham Singh Nagar, wherein the present applicant is implicated for the offence punishable under Section 302 of IPC and now after submission of the charge-sheet, the Sessions Trial No.31 of 2023 is going on. 4. The allegation against the present applicant is for killing his wife. The deceased married with the applicant in the year 2007 and as per the prosecution, the incident took place on 28.07.2023 and after investigation, the charge-sheet was filed; the trial has already been commenced and out of 22 witnesses, uptil date, only five witnesses have been examined. 5. Apart from this, learned counsel for the applicant submits that there is no recovery from the present applicant and the entire prosecution case is based upon circumstantial evidence and there is no direct evidence. 6. Per Contra, Mr. V.S. Pal, learned AGA for the State, opposed the bail application by submitting that the star 2025:UHC:1964 witness, in fact, is the son of the applicant, though he was not the eye witness, but what he has disclosed to the prosecution is that when he asked about his mother from the present applicant, he informed that his mother had run away with some stranger. Apart from this, Mr. V.S. Pal submits that as per the post mortem report, there were multiple injuries on the body of the deceased, however, he has not disputed this fact that the charge-sheet has already been filed; the trial has been commenced and out of 22 witnesses, uptil date, only five witnesses have been examined. 7. After hearing the arguments, as advanced by learned counsel for the parties and further taking into consideration that the charge-sheet has already been filed and the applicant is languishing in jail since 31.07.2023 and out of 22 witnesses, uptil date only five witnesses have been examined, therefore, there is no possibility that the trial would be expedited shortly, this Court is of the view that the applicant deserves to be enlarged on bail. 8. Accordingly, without expressing any opinion on the merit of the case, the present bail application is allowed. 9. Let the applicant, namely, Paramjeet Singh be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
