Learned counsel for the petitioner when pointed out by this Court as to how without posing a challenge to the vires of section 28-A of the Agrarian Reforms Act, 1976, the petitioner who otherwise is a bonafide purchaser of the agrarian land in terms of sale deed dated 24.02.2000 and having earned attestation of mutations thereupon, the petitioner is seeking to maintain present writ petition very candidly submits that though in the writ petition challenge has been thrown to the spirit of the provisions of section 28-A of the Agrarian Reforms Act, 1976 but in the prayer part, no such prayer has been solicited by the petitioner for getting declaration with respect to the vires of section 28-A of the Agrarian Reforms Act, 1976 and, as such, seeks to withdraw the instant petition with liberty to file afresh. Oral prayer is accepted.
2. In view of the above, the instant petition is dismissed as withdrawn with liberty granted to the petitioner. Serial No. 147

3. Let the fresh writ petition be filed within a period of fifteen days and till that time the petitioner’s lawful possession with respect to the land measuring 5 kanals 16½ marlas in khasra No. 193 min in village Khanpur, tehsil Nagrota be not disturbed.
