The present application u/s 528 of BNSS of 2023 has been filed with prayer to quash the entire proceedings of Case No. 209 of 2025 (State of U.P. vs. Brijesh Kumar & others), arising out of Case Crime No. 343 of 2024, under Section 137(2) BNS (363 IPC), P.S. Phase-1, District Commissionerate Gautam Budh Nagar as well as cognizance/summoning order dated 06.01.2025, pending in the Court of Addl. Civil Judge (S.S.)-II/A.C.J.M, District Gautam Budh Nagar. Learned counsel for the applicant submits that as per charge sheet, wherein investigating officer mentioned the present applicant/child in conflict with law. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicant after retaining a photocopy of the same.
