The Application is filed under Section 320(2) r/w Section 482 of Cr.P.C. 3. The affidavit is filed by Jagadeesha C.M., and Mahesh S.P., and a joint memo is filed by the petitioners- accused No.1 and accused No.2 and respondent no. 2, in which - 3 - HC-KAR NC: 2025:KHC:54781 CRL.P No. 17480 of 2025 it is stated that, a settlement arrived between the petitioners and respondent no. 2, and the same is out of free will. There is no coercion or force, fraud or any undue influence in settling the issue. 4. As per settlement, petitioners have paid the complainant/respondent no.2. Rs.1,50,000/- for medical and other expenses. 5. On enquiry, the complainant has stated that he has received the amount through bank account. The contents of this affidavit and the application read over and explained to both parties. Both parties have agreed as to the terms of settlement. Though the offences are not compoundable, however, in view of settlement arrived at between the parties and considering the nature, facts and the circumstances of the case by exercising the power under Section 482 of Code of Criminal Procedure r/w 528 of Bharatiya Nagarika Suraksha Sanhita, 2023, in the interest of both parties, I proceed to pass the following: - 4 - HC-KAR NC: 2025:KHC:54781 CRL.P No. 17480 of 2025 ORDER i) The petition is allowed. ii) Compromise recorded. iii) The proceedings pertaining to Cr.No. 342/2025 of Rural Police, Chikkamagaluru, for the offence punishable under Sections 115(2), 118(1), 190 and 109 of BNS, 2023 insofar as it relates to the petitioners herein, is quashed.
