JUSTICE RAJESH RAI K ORAL ORDER (PER: HON'BLE MR. JUSTICE D K SINGH) In compliance of the order dated 13.10.2025 passed by this Court in the present writ petition, Major P. Manivannan, IAS, the Commissioner, Bengaluru Development Authority, (for short 'the BDA') is present before this Court. He submits that the BDA was unsuccessful upto the Supreme Court in respect of the acquisition of the land of respondent Nos.5 to 8 and acquisition proceedings in respect of their land have been quashed. The BDA is willing to allot alternate site to the petitioner out of 29 sites available with the BDA as per their choice. He further submits that the petitioner was promised allotment of one acre of land for educational purposes and for the said purpose, out of 29 sites available with the BDA, the same extent of land shall be - 5 - HC-KAR NC: 2025:KHC:40603-DB WP No. 18760 of 2018 allotted to the petitioner in one of the sites as may be chosen by the petitioner. 2. Mr. G Krishnamurthy, learned Senior Counsel appearing for the petitioner, on instructions from the petitioner, submits that the petitioner may be allotted one acre of land in CA site No.15 in Sir M Vishveshwaraya Layout, 3rd block. 3. The Commissioner, BDA submits that the BDA will accept the choice of the petitioner and will take steps for allotment of around one acre of land in CA Site No.15 of Sir M Vishveshwaraya Layout, 3rd block, subject to execution of necessary documents between the parties and payment of applicable charges/fees. 4. In view of the above, nothing survives in this petition and we therefore, dispose of the writ petition in terms of the understanding arrived at between the parties as mentioned above. - 6 - HC-KAR NC: 2025:KHC:40603-DB WP No. 18760 of 2018 In view of disposal of the petition, pending I.As, if any, stand disposed of as they do not survive for any consideration.
