1. The applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 161/2025, registered at Police Station : Akaltara District- Janjgir- Champa (C.G.) for the offence punishable under Sections 296, 115(2), 3(5), 118(2) of the Bhartiya Nyay Sanhita, 2023.

Learned counsel for the applicant submits that during the course of investigation in the present case, Section 109 of the BNSS has KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 been added. Though this fact has been mentioned in the grounds, it was inadvertently not reflected in the particulars of the bail application. As the bail application of the applicant does not include the newly added offence under Section 109 of BNSS, which has now been incorporated, the counsel seeks permission to withdraw the present application with liberty to file a fresh application including the added offence along with the other offences already mentioned.
3. In view of the same, the present bail application is dismissed as withdrawn, with aforesaid liberty.
4. Certified copy of the documents annexed in the bail application, if any, may be returned back to the counsel for the applicant after obtaining the photocopy of the same Sd/-
