The petitioner is apprehending his arrest in connection with Bashistnagar P.S. Case No.80 of 2024, for offence registered under section 317(5), 274, 275, 3(5) of BNS, 2023 and section 47(A) of Excise Act, pending in court of learned Chief Judicial Magistrate, Chatra.

Learned counsel for petitioner submits that petitioner is not named in the FIR and name of the petitioner has come on taking confessional statement of the apprehended co-accused namely Kundan Kumar. He also submits that one mobile of the petitioner was lost in Patna and that mobile was recovered from the possession of the apprehended co-accused. He then submits that petitioner has got no criminal antecedent as disclosed in paragraph no.20.
4. Learned State counsel opposes prayer and submits that illegally 372 bottles of foreign liquor were being carried on Tavera vehicle.
5. Considering that the petitioner is not named in the FIR and name of the petitioner has come on confessional statement of the co-accused namely Kundan Kumar. It has been pointed out that the mobile of the petitioner was lost at Patna and that mobile was recovered from the possession of co-accused Kundan

Kumar and the petitioner has got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Chatra, in connection with Bashistnagar P.S. Case No.80 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
