ELEVATED AS JUDGE The Court made the following: ORDER: The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: “… to issue a writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the 3rd respondent in issuing the notice vide No.29/2016 dated 10.02.2016 thereby directing petitioners to hand over the property 2 and further threatening to dispossess by way of conducting Tender-cum-Auction over the petitioners and their family members property bearing Door No.11-5-9/1 in total extent of 315 Sq Yds in R.S.No.45 of Tadepalligudem is illegal, irregular, arbitrary and violative of provisions under Andhra Pradesh Charitable and Hindu Religious Institutions Endowments Act, 1987 and Rules framed there under and also offends Articles 14, 21 and 300-A of Constitution of India and consequently set aside the notice issued by the 3rd respondent vide notice No.29/16 dated 10.02.2016…” 2. Heard Mr T.V.Jaggi Reddy, learned counsel for the petitioners and the learned Government Pleader for Endowments appearing for the respondents. 3. On hearing, learned counsel for the petitioners submits that the matter is squarely covered by the order passed by this Court in W.P.No.6502 of 2016, dated 10.02.2025, and hence, requests this Court to pass similar order in this petition also. The operative portion of the said order is as follows:- “..7. Considering the submissions of learned counsel for the petitioner and the learned Government Pleader for Endowments, the Hon’ble Endowments Tribunal, Hyderabad is directed to dispose of O.A.No.197 of 2013 within a period of Six (6) months from the date of receipt of a copy of this order. Till then, the respondents are directed not to interfere with the possession of the petitioner over the subject property without following due process of law. 8. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs...” 3 4. Learned Government Pleader for Endowments appearing for the respondents opposed for grant of any relief in the writ petition and prayed to dismiss the same. 5. In view of the submission made by both the learned counsels and upon perusing the entire material available on record, this Court deems fit to dispose of the present Writ Petition in terms of the said order. 6. Accordingly, this Writ Petition is disposed of in terms of the order passed in W.P.No.6502 of 2016, dated 10.02.2025. There shall be no order as to costs. 7. The Registry is directed to attach a copy of the order passed in W.P.No.6502 of 2016, dated 10.02.2025 to this order.
