DEPUTY SOLICITOR GENERAL OF INDIA The Court Made the Following Order:- This Writ Petition under Article 226 of the Constitution of India is filed for the following relief: “to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus declaring the 1st respodnents impugned action of enhancing the age of retirement on superannuation from 60 years to 65 years with prospective date vide Letter No PR12016/7/2016PE1 Dt 30.09.2017 in blatant deviation from the Union Cabinets decision dated 27.09.2017 2 which specifically speaks for Ex-post facto approval of the said enhancement as patently illegal arbitrary vitiated by hostile discrimination and in clear violation of the Articles 14, 16 and 21 of the Constitution of India and to pass...” 2. Today, when the matter is taken up for hearing, it is jointly submitted by Sri I.Venkata Prasad, learned counsel for the petitioner and the learned Standing Counsel for the respondent No.3, that the petitioner was retired from service on 31.08.2016 and he also received all the benefits from the concerned authorities. While making the submissions, they state that the cause in the lis does not survive for adjudication and seeks closure of the writ petition. 3. Recording the submissions made by both the counsels, the writ petition is closed. No costs.
