Ms. Sheenu Sura, Deputy Advocate General, Haryana. *** MANISHA BATRA, J (ORAL):- The instant petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner for setting aside the order dated 20.03.2025 passed by learned Additional Sessions Judge, Kurukshetra in Criminal Appeal No. 140 of 2024, titled as Lehri Singh Vs. Bala Devi, whereby the application filed by the petitioner for waiver of remaining amount of 20% was dismissed.

After arguing for some time, learned counsel for the petitioner restricts his claim to the extent to grant some more time to the petitioner to deposit 20% of the compensation amount with further condition to be imposed upon the respondent to return the same, if the appeal filed by the petitioner before the learned Appellate Court succeeds.
3. Vide order dated 20.03.2025, passed by the learned Appellate Court, the prayer made by the petitioner for waiver of payment of 20% of Parveen Sharma 2025.03.28 14:56 I attest to the accuracy and integrity of this document

4. Since the only prayer made by the petitioner now, is to the above extent, therefore, the petition is disposed of. The petitioner is granted 15 days’ time from today to deposit 20% of the compensation amount with the concerned Court. He shall also be entitled to return of the same from the complainant, if appeal and any subsequent proceeding arising therefrom are decided in favour of the petitioner.
5. Since the main petition has been disposed of, pending application, if any, is rendered infructuous.
