27.03.2025 Sl. No.1(DL) Ct. No.39 srm IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION APPELLATE SIDE W.P.A. No. 21547 of 2024 With CAN 1 of 2025 Nuruddin Momin @ Nooraddin Momin Versus The State of West Bengal & Ors. Ms. Salma Sultana Shah, Mr. Sani Hossain …for the Petitioner. Mr. Santanu Maitra, Ms. Kakali Pal …for the State-respondents. Affidavit of service filed on behalf of the petitioner is taken on record. Re: CAN 1 of 2025 This is an application for restoration of the writ petition by recalling the order dated 14th January, 2025. By order dated 14th January, 2025, the writ petition being WPA 21547 of 2024 was dismissed for default. Ms. Salma Sultana Shah, learned Advocate appearing for the petitioner submits that on the date of the hearing learned Advocate failed to appear since she was engaged in another Court, resulting in dismissal of the writ petition. She seeks for restoration of the writ petition upon recalling the order of dismissal. 2 Ms. Kakali Pal, learned Advocate appearing for the State-respondents leaves the matter to the discretion of the Court. Considering the averments in the application and submissions advanced on behalf of the petitioner, it is found that sufficient cause has been shown to restore the writ petition upon recalling order of dismissal. Accordingly, order of dismissal dated 14th January, 2025 is recalled. The writ petition being WPA 21547 of 2024 is restored to its original file and number. The application being CAN 1 of 2025 stands disposed of. Re : W.P.A. No. 21547 of 2024 List this matter on 16th April, 2025 under the heading “Motion”. (Bivas Pattanayak, J.)
