The petitioner had earlier approached this Court through Matters under Article 227 No. 2895 of 2022 which was disposed of by order dated 21.04.2022 and following order was passed- "Heard learned counsel for the petitioner. Present petition has been filed with following prayer:- "(i). Issue a writ, order or direction in the suitable nature commanding the respondent no. 3, Civil Judge, Senior Division, Kanpur Nagar to expedite Original Suit No. 918 of 2021 (Smt. Misha Silas Vs. Smt. Veena Silas and another) filed for declaration under Section 34, Prohibitory Injunction under Section 38 of the Specific Relief Act, 1963, pending before him, within the stipulated period, which this Hon'ble Court may deem fit and proper under the circumstances of the case." In the facts and circumstances of the case, the present petition is disposed of with direction to the Civil Judge, Senior Division, Kanpur Nagar to expedite the hearing of the aforesaid case and decide the same expeditiously, in accordance with law after providing opportunity of hearing to all concerned." The present writ petition has been filed with the following prayer:- "A. Issue a writ, order or direction in the suitable nature commanding the Civil Judge, Senior Division, Kanpur Nagar to expedite Original Suit No. 918 of 2021 (Smt. Misha Silas Vs. Smt. Veena Silas and another) filed for declaration under Section 34, Prohibitory Injunction under Section 38 of the Specific Relief Act, 1963, pending before him, within the stipulated period." From perusal of the prayer made in the writ petition, it transpires that petitioner had earlier approached this Court with the same relief and this is a second writ petition. The second writ petition is not maintainable. In view of above, the writ petition is dismissed.
