Hon'ble Prakash Padia,J. 1. Heard Sri Vineet Sankalp, learned counsel for the petitioner and learned Standing Counsel appearing on behalf of State-respondents. 2. The petitioner has preferred the present petition inter alia with the following prayer:- "I. Issue a writ order or direction in the nature of mandamus to direct the respondent no. 2 to pass the challan to deposit the renewal fees of Arms License No. 4586 P.S. Atarra, District Banda of the petitioner." 3. Facts in brief as contained in the writ petition are that the petitioner having License No. 4586 P.S. Atarra, District Banda and the petitioner purchased the DBBL gun No. 29797-01 on his Arm License. The arm license of the petitioner has been cancelled through impugned order dated 21.08.2019 passed by District Magistrate, Banda. The aforesaid order has been challenged before the Learned Commissioner Chitrakoot, District Chitrakoot and the Commissioner Chitrakoot set aside the order dated 21.08.2019. Subsequent to the same District Magistrate, Banda restored the Arm License No. 4586 P.S. Atara District Banda of the petitioner and passed the order dated 12 June, 2024 in Case No. RST/349/2024 State Vs. Ramlakhan and the learned District Magistrate Banda also released the weapon of the aforesaid license in favour of the petitioner. Subsequent to the same the petitioner deposited the renewal fees of the aforesaid arm license No. 4586 for the period 01.01.2020 to 31.12.2022 through Challan Form. It is argued that after the aforesaid exercise, the petitioner approached in the office of the District Magistrate Banda, District Banda/respondent no. 2 for passing the appropriate orders on the challan form for depositing the renewal fees of the aforesaid Arm License No. 4586 but no order has been passed. Since no decision has been taken, the petitioner could not deposit the renewal fees of the aforesaid arm license. Hence the present petition. 4. Pursuant to the order passed by this Court, instructions dated 04.05.2025 under the signatures of District Magistrate, Banda is placed before this Court, the same is taken on record. 5. In the aforesaid instructions a reference has been made in respect of the Government Order issued by the State Government dated 17.03.2017, on the basis of the same following averments made in the instructions which reads as follows:- ""उपररोक्त कके सम्बन्ध मम यह भभी अवगत कररानरा हहै कक सकचिव गगृह , अननुभराग-5, उ०प्र० शरासन, लखनऊ कके पत्र ससंख्यरा -जन 102/छछ- पपू०-5-2017-1(12) / 2005. कदिनरासंक 17-03-2017 (छरायराप्रकत ससंलग ) मम यह प्रराकवधराकनत हहै "कक प्रत्यकेक शस्त्र लराइसमससों करा रराषषभीय डराटरावकेस (एन०डभी०ए०एल०) तहैयरार ककयरा जरानरा हहै, जजसकके जलए कदिनरानाँक (31-03-2017 करो अनन्तम कतजथ कनधरार्धाररत ककी गयभी थभी। उक्त कतजथ कके पश्चिरातत् लराइसमसधरारक करा शस्त्र लराइसमस कदिनरा यपू०आई०एन० (यपूनभीक आईडकेनन्टटभीकफिकके शन नम्बर) कके कदिनरानाँक 01-04-2017 करो स्वतछ अवहैध (Invalid) हरो जरायकेगरा, जजसककी समस्त जजम्मकेवरारभी स्वयसं जजम्मकेवरारभी लराइसमसभी ककी हरोगभी। ऐसभी नस्थकत मम कबनरा यपू०आई०एन० (यपूनभीक आईडकेनन्टटभीकफिकके शन नम्बर) कके शस्त्र लराइसमस करा नवभीनभीकरण ककयरा जरानरा कवजधक नहहीं हहै।" उपररोक्त सके स्पष हहै कक यराचिभी करा शस्त्र NDAL परोटर्धाल पर पसंजभीकगृ त नहहीं हहै तथरा न हभी उनकके शस्त्र मम यपूकनक आई०डभी० नम्बर अलराट हहै। अतछ ऐसभी नस्थत मके उपररोक्त शरासनरादिकेश कके अननुसरार यराचिभी करा शस्त्र अवहैध हहै तथरा उसके नवभीनभीकगृ त ककयरा जरानरा कवजधससंगत नहहीं हहै उपररोक्त तथ्यरो सके मरा० न्यरायरालय करो अवगत कररातके हहए ररट यराकचिकरा कनस्तराररत कररानके करा कष करके।" 6. On the basis of aforesaid, it is argued that since the U.I.N (Unique Identification Number) was no available with the petitioner he is not entitled for any arm license. 7. Heard counsel for the parties and perused the record. 8. From the perusal of record, it transpires that the gun license of the petitioner was cancelled by the respondent no. 2 on 31.08.2019, the aforesaid order was set aside in appeal vide order dated 12.08.2021, subsequent to the same the arm license of the petitioner was revoked by the respondent no. 2 on June 12, 2024, immediately thereafter proceedings were initiated to deposit the renewal fees. From the perusal of the facts as narrated above, it is clear that the arm license of the petitioner was cancelled on 31.08.2019 and the same was revoked on 12th June, 2024. 8. In this view of the matter, the Court is of the opinion that the Government Order dated 17th March, 2017 according to which the UIN number should be available with the arm license holder on or before 31st March, 2017 will not apply in the case of the petitioner. 9. In this view of the matter, the present petition disposed of finally directing the respondent no. 2 to pass appropriate orders in the application submitted by the petitioner to deposit the challan for renewal fees of arm license most expeditiously and preferably within a period of three weeks from the date of presentation of certified copy of this order. Further a mandamus is issued to the respondents to open the necessary portal in order to provide UIN number to the petitioner. 10. With the aforesaid observation the writ petition stands allowed.
