KOTA VENKATA RAMA RAO (SC FOR APSPDCL) The Court Made the Following Order:- This Writ Petition under Article 226 of the Constitution of India is filed for the following relief: “to issue a Writ Order or Direction more particularly one in the nature of Writ of MANDAMUS by declaring the action of the respondents in not considering the case of the petitioner for promotion to the post of Assistant Lineman as illegal arbitrary and unconstitutional being violative of Articles 14 and 16 of the Constitution of India and consequently direct the respondents to consider the case of the petitioner for promotion to the 2 post of Assistant Lineman with all consequential benefits in the light of the instructions issued by 1st respondent in Memo No CMD/CGM/ HRD/JS/HR/DGMII/POIV/JPO 2/F No 268/D No 17/16 dated 06012016 and to pass...” 2. On 10.06.2016, this Court directed the respondent authorities to the consider the case of the petitioner for promotion to the post of Assistant Lineman, if he is otherwise eligible and qualified, pending further orders in the Writ Petition. 3. Consequently, the respondent authorities have issued speaking orders informing that the petitioner is ineligible for promotion of ALM as he has not procured the successful training completion certificate and also he has not been exempted from possessing of ITI qualification. 4. Heard learned counsel for the petitioner and Sri Kota Venkata Rama Rao, learned Standing Counsel for APSPDCL. 5. Learned Standing Counsel for APSPDCL has placed a copy of proceeding issued by Executive Engineer, Gudur, vide Memo No: EE/O/GDR/ADM/JAO/SA 1/D.No:158/2024, dated 12.02.2024 and submits that the petitioner was promoted as Line Man on 12.02.2024 by the respondent authorities and presently he is working at Griddaluru Distribution of Sydapuram Section. The proceeding dated 12.02.2024 issued by Executive Engineer, Gudur, is made part of the record. 3 6. The above said assertions were not disputed by the learned counsel for the petitioner and he sought for closure of the lis. 7. Acting upon the contents of the proceeding dated 12.02.2024 issued by Executive Engineer, Gudur, coupled with the petitioner’s request, no further orders are required in this writ petition. Hence, the Writ Petition is closed. There shall be no orders as to costs.
