---- 02/28.11.2025 Heard learned counsel appearing for the petitioners, learned counsel appearing for the State and learned counsel appearing for the Informant.
2. The petitioners are apprehending their arrest in connection with Poraiyahat P.S. Case No.50 of 2025, for the alleged offences registered under Sections 126(2), 115(2), 117(2), 109, 303(2), 324(5), 352, 351(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned S.D.J.M., Godda.

Learned counsel appearing for the petitioner submits that there are case and counter case between the parties. He further submits that the scuffle took place due to forcefully encroaching upon the government road by putting bamboo in front of the shop of the petitioner wherein the

petitioner is having a shop of electronic goods. He then submits that the injury is said to be simple in nature.

Learned counsel appearing for the State and Informant opposes the prayer and submits that the scuffle took place and even the injury has been received by three persons and one of the injury is said to be grievous in nature.

Considering that there are case and counter case between the parties and the scuffle took place due to encroachment upon the government road which has been opposed by the petitioners’ side and in the order of learned Sessions Judge it has come that the injury is simple in nature and one of the injury is said to be grievous in nature, I am inclined to provide anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Godda in connection with Poraiyahat P.S. Case No.50 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
