Baghel, learned Deputy Government Advocate, appearing for the State/respondents. 2 The present petition has been filed by the petitioner under Article 226 of the Constitution of India with the following prayers :- ROHIT KUMAR CHANDRA Digitally signed by ROHIT KUMAR CHANDRA 2 “10.1 That, this Hon'ble Court may kindly be pleased to pass a writ of mandamus or any other appropriate writ of, order or direction and summon the entire relevant record from the possession of the court below; 10.2 That, this Hon'ble Court may kindly be pleased to pass a writ of mandamus or any appropriate writ, order or direction holding and declaring that the withholding of the Bid Security by Respondents of Rs. 15,26,84,208/- is arbitrary and illegal and the Bid Security amounting to Rs. 15,26,84,208/- be released and returned to the Petitioner as the entire Tender/Bid has now lapsed in terms of the Tender Document clause 14.12; 10.3 Award Cost of the litigation in favour of the Petitioner. 10.4 Any other relief or relief(s) which this Hon'ble Court may deem fit and proper in view of the facts and circumstances of the case, may also kindly be granted.” 3 Learned counsel for the petitioner prays for withdrawal of the present petition with liberty to file a duly constituted petition with appropriate prayers and pleadings. 4 Accordingly, the instant petition is dismissed as withdrawn with liberty to file a duly constituted petition with appropriate prayers and pleadings, subject to depositing a sum of Rs.25,000/- as cost by the petitioner in the Registry of this Court for wasting the precious time of the Court and the same shall be transmitted to Government Special School for Intellectually Retarded Girls, Gaganpur, Ambikapur, District – Sarguja (C.G.).
