CRP(PD).No.1232 of 2025 O R D E R Aggrieved by the fact that the Court below has granted interim maintenance to the wife who is employed, the petitioner is before this Court. 2. The respondent/wife had taken out an application in OP.No.4869 of 2022 filed by her for divorce claiming an interim maintenance of Rs.10,000/- for herself and Rs.10,000/- for her minor daughter and a sum of Rs.30,000/- towards litigation expenses. She has contended that she is not earning and that the respondent who is assisting his father in the family business is earning a sum of Rs.50,000/- per month but has failed to maintain either herself or the child. 3. The petitioner/husband would submit that the respondent/wife left her matrimonial home without any rhyme or reason and is acting as a puppet in the hands of her father and brother. The respondent/wife is highly qualified and capable of earning herself, whereas the petitioner/husband has studied only up to the 12th standard and earns only Rs.2,500/- per week as a collection agent in a 2/5 https://www.mhc.tn.gov.in/judis

The learned III Additional Principal Family Judge, Chennai after hearing the parties and perusing the records had ordered a sum of Rs.2,500/- to the 1st respondent/wife and a sum of Rs.5,000/- to the 2nd respondent/child. Challenging the same the petitioner is before this Court. 5. Heard the counsel on either side and perused the records. 6. The petitioner/husband is particularly aggrieved by the maintenance amount granted to the wife, who had voluntarily left the matrimonial home and filed a petition for divorce. He has no objection to make the payment for his child. 7. In view of the above, the Civil Revision Petition is partly allowed.
The maintenance that has been granted to the wife is set aside and the maintenance granted to the 2nd respondent/ child is enhanced from a sum of Rs.5,000/- to a sum of Rs.7,000/- per month. The arrears shall be paid and only thereafter the main OP will be 3/5 https://www.mhc.tn.gov.in/judis
