PUBLIC PROSECUTOR (AP) 2 Crl.A.No.1347 of 2017 Dt. 09.07.2025 SAB / TSNR The Court made the following JUDGMENT :- (Per the Hon’ble Sri Justice K.Suresh Reddy) Questioning the judgment of acquittal, dated 28.06.2017 passed by the learned Judge, Family Court-cum-III Additional Sessions Judge, Vizianagaram, in S.C.No.24 of 2016, the defacto complainant/P.W.1 filed the present appeal under Section 378(3) & (1) of Cr.P.C. 2. Brief facts of the case are : A.1 is husband of the deceased, A.2 and A.3 are parents of A.1, A.4 is married sister of A.1, A.5 is husband of A.4. All the five accused were prosecuted under Section 498-A, 302, 304-B and 201 read with 34 IPC and Sections 3 and 4 of Dowry Prohibition Act. 3. Today, when the matter is taken up, learned counsel for the appellant filed a Memo stating that the husband of the deceased i.e., A.1 and in-laws of the deceased i.e., A.2 and A.3 died during pendency of the present Criminal Appeal. So far as, A.4 is concerned, she is married sister of A.1 and A.5 is the husband of A.4. As such, P.W.1 is not interested in prosecuting the present appeal as the main accused i.e., A.1 to A.3 died during pendency of the present Appeal and requests this Court to dismiss the present Appeal as not pressed. 4. On the other hand, the learned Additional Public Prosecutor, on instructions, confirms the factum of death of A.1 to A.3. 5. Recording the said statement, the present Criminal Appeal is dismissed as not pressed. Consequently, miscellaneous petitions, if any, pending shall stand closed.
