Heard the learned counsel for petitioner, learned HCGP for the State and perused the material on record.
2. This petition is preferred under Section 483 of BNSS, 2023 praying to enlarge the petitioner on bail in Cr.No.26/2025 of Kolar CEN Police Station, Kolar, registered for the offence punishable under Section 20(b)(ii)(B) of the NDPS Act.

Brief facts: The complainant-CPC 393, CEN Crime Police Station, Kolar, received a credible information while on patrolling duty on 18.7.2025 at about 7.00 a.m., that a person by name P.Rajendra, resident of Andhra Pradesh has purchased 4 kgs. of Ganja from Andhra Pradesh and he is trying to sell it to one Shashikumar, a resident of Mulbagal. On the basis of his complaint,

aforementioned case was registered against Rajendra (accused No.1) and Shashikumar (accused No.2). On the same day, at about 4.00 p.m., the Dy.S.P. and his staff along with panchas while keeping a vigil at NH 75, Mulbagal, noticed three persons near a two wheeler and one of them was holding a plastic bag. When they tried to apprehend, one of them (accused No.2) escaped and petitioner and another accused was apprehended.
4. It is alleged that 4 kgs. 405 gms. of ganja was seized from accused No.1-Rajendra concealed in 2 bundles, one kept in the hand bag he was holding and another bundle kept in the side bag of his motorcycle. From the petitioner/accused No.3, 5 gms. of ganja was alleged to be recovered.
5. Learned High Court Government Pleader contended that if the petitioner is granted bail, he may flee from justice and commit similar offence.

6. The ganja allegedly seized from the exclusive possession of petitioner is 5 gms., which is a small quantity. Petitioner has no bad antecedents. He is said to be a permanent resident of Mulbagal, Kolar District. He is not required for further interrogation. The apprehension of the prosecution can be safeguarded by imposing suitable conditions. Hence, by imposing conditions, petitioner can be enlarged on bail. Accordingly, the following:
ORDER I. Petition is allowed. II. Petitioner/accused No.3 in Crime No.26/2025 of Kolar CEN Police Station, Kolar District, shall be enlarged on bail, subject to following conditions:
1. He shall execute a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only), with two sureties for the likesum to the satisfaction of the jurisdictional Court.

2. He shall furnish his residential address and shall inform the Court, if there is change in the address.
3. He shall not directly or indirectly tamper with the prosecution witnesses.
4. He shall not indulge himself in committing any offence.
5. He shall appear before the trial Court regularly on all dates of hearing.
Violation of condition/s shall result in cancellation of bail.
