The present petition under Article 227 of the Constitution of India has been filed with the following relief:- "1. call the records of the learned courts below and set-aside the impugned judgment and order dated 20.02.2025 passed by learned Session Judge, Budaun in Criminal revision No. 214 of 2024 (Vicky Shakya vs. Om Prakash alias Thakur Das and others) and also the impugned order dated 09.08.2024 passed by learned Ist Additional Civil Judge (S.D.)/A.D.J.M., Budaun (Vicky Vs. Om Prakash and others) in Misc. Case No. 1005 of 2024, under Section 156(3) Cr.P.C. (Annexure Nos. 1 and 2 to the petition). 2. issue an order of direction in the nature of Power of Superintendent directing the Police Station Ujhani District Budaun to lodge the First Information Report in suitable Sections against the respondent no. 2 and 3." It has been submitted by learned counsel for the petitioner that the application filed by the petitioner under Section 156 (3) Cr.P.C. has been rejected and the revision filed by the petitioner has also been rejected, though there is sufficient material to proceed with. Considering the aforesaid submission, in case, the petitioner moves a fresh application with complete details for lodging the complaint under section 210 BNS within a period of one month from the date of the order, the same may be considered and decided strictly, in accordance with law after giving an opportunity of hearing to both the parties, if there is no legal impediment.
