2. Petitioner has been made accused in connection with Cyber Crime P.S. Case No. 65 of 2025 for the offences registered under sections 318(4), 319(2), 336(3), 338, 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 66(C), 66(D) of the I.T. Act, pending in the court of learned Special Judge (Cyber Crime), Dhanbad.

On 01.09.2025, Chirkunda Police on the basis of confidential information that cyber criminals have assembled near Lower Bazar, Chirkunda, raided the place of occurrence and apprehended four accused persons including the petitioner. On search, nine mobile phones are alleged to have been recovered from there.
4. It was submitted that a joint seizure list was made by the raiding party. It was further submitted that there is no specific allegation as to which mobile was recovered from each of the accused.
5. Mr. Shailendra Kumar Tiwari, learned Special P.P has opposed the prayer for bail and submitted that during the course of investigation, it transpired that one of the mobile phones so recovered, was used in cheating a person. However, on specific query as to from whose possession this mobile phone was recovered, he replied that this fact has not come during the course of investigation.
6. It appears that similarly situated co-accused persons have been granted bail by his court earlier.
7. In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty
