ORDER: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-
“….to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the proceedings of the 3rd respondent in Ref.V9/CS/623/2016 dated .09.2016 in rationalization of the petitioners’ Fair Price shops situated in Karapa Mandal, East Godavari District and the consequential proceedings of the 4th respondent in Ref.D/1910/2016 dated 26.9.2016 to bifurcate the petitioners’ fair price shops and constitute new Fair Price shops as wholly illegal, arbitrary and in violation of Principles of natural justice and consequently set aside the above proceedings of the respondents 3 and 4 ….”
2. Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Civil Supplies. 3. It is brought to the notice of this Court that, under similar circumstances, this Court, in W.P.No.34566 of 2016 passed the following order on 15.03.2023:
“No interim order was granted by this Court earlier.
In view of the same and on perusal of the material on record, the Writ Petition is closed, giving liberty to the petitioners, if they have any grievance, to challenge the appointment, pursuant to the notification dated 24.09.2016 in another proceedings.”
4. In view of the same this Writ Petition is also closed in terms of the order dated 15.03.2023 passed by this Court in W.P.No.34566 of 2016. 4 VS,J W.P.No.35969 of 2016
