04/ 12.12.2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Sahibganj (T) P.S. Case No. 101 of 2025, registered for the offences under Sections 126(2), 115(2), 118(1), 109(1) and 303(2) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Sahibganj.

Learned counsel appearing for the petitioner submits petitioner is a resident of nearby place where the alleged occurrence has said to be occurred. He further submits in view of that there is possibility that the petitioner has been noticed in the CCTV Camera. He then submits that there are general and omnibus allegations against all the accused persons. He next submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para- 13 of the petition. He further submits that in the similar circumstance the other co-accused person has already been provided the privilege of anticipatory bail in A.B.A. No. 6914 of 2025 by this court.

Learned A.P.P. appearing for the State has opposed the prayer and submit that the informant has received the injury.

Considering that the said occurrence is said to be during the Moharram procession and it has been pointed out that the petitioner is a resident of nearby area and he is having no criminal antecedent and disclosure to that effect has been made in para-13 of the petition and further in the similar circumstance the other co-accused person has already been provided the privilege of anticipatory bail in A.B.A. No. 6914 of 2025 by this court, I am inclined to provide the privilege of anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is hereby
directed to surrender before the learned court within three weeks from today, and in the event of her surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Sahibganj, in connection with Sahibganj (T) P.S. Case No. 101 of 2025, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
