SHALINI Counsel for the Respondents: GP FOR AGRICULTURE (AP) The Court made the following order: 3 HON’BLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION No.14600 of 2016 ORDER: The instant writ petition has been filed by the petitioner under Article 226 of Constitution of India, seeking the following main relief: “Issue a Writ order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in trying to retire the petitioner at the age of 58 years instead of 60 years is contrary to the provisions of Act 4, dated 27.06.2014, as illegal, arbitrary and ultra vires the Constitution of India and consequently direct the respondents to continue the petitioner up to 60 years of age in the interest of justice and to pass …..” 2. The sum and substance of the writ petition is that the petitioner is seeking to continue his services up to the age of 60 years. On 27.04.2016, this Court passed the following interim order: “It is brought to the notice of this Court that the 2nd respondent – A.P.State Seeds Certification Agency governing board unanimously passed resolution on superannuation. In view of the same, there shall be interim direction as prayed for.” 3. Today, when the matter is taken up for hearing, no representation for the petitioner. The matter is passed over in the morning session. In the revised call at afternoon session, Sri P.Venkata Rama Sarma, learned counsel appearing on behalf of Ms.M.Shalini, learned counsel for the petitioner states that presently the petitioner is not in touch with them. 4 4. The learned Assistant Government Pleader appearing for the respondents submits that consequent to the interim direction passed by this Court, petitioner’s services were extended up to the superannuation age of 60 years. Thus, the cause in the writ petition does not survive for further adjudication. 5. Recording the said submission made by the learned Assistant Government Pleader, the instant writ petition is closed. However, this order will not preclude the petitioner from taking recourse to law as permissible, if so advised. There shall be no order as to costs.
