Heard learned counsel for the parties and perused the record. 2. The instant writ petition has been filed for following relief: "I. Issue a writ order or direction in the nature of mandamus directing to the respondents No. 2 i.e. Sub- Divisional Magistrate Tehsil Padrauna, District Kushinagar to demarcation the land of the petitioner, based on the measurement of Arazi No. 273 area 0.0482 air land is equal on the basis of map and Khatauni the stone marking should be done correctly and by sowing the way. ІІ. Issue a writ order or direction in the nature of mandamus directing the respondent No. 2 i.e. Sub- Divisional Magistrate Tehsil Padrauna, District Kushinagar to decide the representation dated 10.02.2025 moved by the petitioner is still pending before him (Annexure no. 7 writ petition)." 3. Contention of the learned counsel for the petitioners is that the case being Computerized Case No.D202405440001287 under Section 41 of the U.P. Land revenue Act is pending before Additional District Magistrate, Kushinagar for adjudication. He prayed that the same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the Additional District Magistrate, Kushinagar to consider and decide the Computerized Case No.D202405440001287, in accordance with law, expeditiously, preferably within a period of six months from the date of production of a certified copy of this order after ensuring service upon all the respondents, after giving opportunity of hearing to the parties concerned and after giving a reasonable opportunity of leading evidence in respect of their case provided that there is no other legal impediment.
