Heard Mr. Kailash Nath Singh, learned counsel for the petitioner and Mr. R.C. Srivastava, learned Additional Chief Standing Counsel for the State respondents. 2. The instant petition has been filed for the following relief:- "Issue a writ, order or direction in the nature of mandamus directing the respondent no.2, Settlement Officer of Consolidation, Jaunpur to decide the appeal No. 0577 (Indrajeet Vs. Amar Nath and Others) under Section 11 (1) of U.P.C.H. Act situated at Village Hasrauli, Pargana Rari, Tehsil Sadar, District Jaunpur within stipulated period which may fixed by this Hon'ble Court." 3. Counsel for the petitioner submitted that appeal under Section 11 (1) of the U.P.C.H. Act filed in the year 2012 was allowed vide order dated 27.5.2017 but on the recall application filed by private respondents, the order dated 27.5.2017 has been recalled and title appeal has again been restored to its original number. He submitted that the aforementioned appeal filed by petitioner in the year 2012 is still pending before respondent no.2, Settlement Officer Consolidation, Jaunpur. He further placed the order sheet of the pending proceeding in order to demonstrate that matter is not proceeding expeditiously. 4. Considering the facts and circumstances of the case, the petition is finally disposed of directing the respondent no.2, Settlement Officer Consolidation Jaunpur to decide the aforementioned appeal after affording opportunity of hearing to both parties expeditiously preferably within period of two months from the date of production of certified copy of this order before him.
