Order 18/09/2025
1. By way of filing this writ petition, a challenge has been led to the impugned order dated 19.08.2025 by which the respondent- University has decided not to grant provisional/ annual affiliation to the petitioner-institution for the Academic Session 2025-26 and the Academic Session 2025-26 has been declared as zero session.
2.
Learned counsel for the petitioner-institution submits that on two earlier occasions, i.e., for session 2023-2024 and 2024-25, provisional/ annual affiliation was granted to the petitioner- institution to run the Diploma in Pharmacy Course, but this time, without any justified reason, the affiliation has not been granted to the petitioner-institution for the upcoming session 2025-26 and
[2025:RJ-JP:38357] (2 of 3) [CW-13756/2025] without any justified reason, the upcoming Academic Session 2025-26 has been declared as zero session.
3. Counsel submits that when an inspection was done by the respondent-University, certain deficiencies were pointed out and these deficiencies were cured as well as the same was brought into the notice of the respondent-University by the petitioner vide reply dated 10.07.2025. Counsel submits that in spite of the above, without issuing any notice and without affording any opportunity of hearing, the respondent-University has passed the
order impugned, hence, the same is not tenable in the eyes of law and is liable to be quashed and set-aside.
4. Per contra, learned counsel appearing on behalf of the respondent-University opposes the arguments raised by counsel for the petitioner-institution and submits that a detailed inspection was conducted of the petitioner-institution and thereafter, an inspection report was prepared on 10.07.2025, wherein five deficiencies were found and all those deficiencies were not cured by the petitioner-institution, hence, under these circumstances, the order impugned has been passed, which warrants no interference of this Court and the writ petition is liable to be rejected.
5. Heard and considered the submissions made at the Bar and perused the material available on record.
6. Various versions and cross-versions have been made by both the respective sides with regard to the deficiencies and removal of deficiencies. It is the case of the petitioner-institution that all the deficiencies as pointed out by the respondent-University have been cured while the case of the respondent-University is that the
[2025:RJ-JP:38357] (3 of 3) [CW-13756/2025] deficiencies as pointed out during the inspection have not been cured, hence, the respondent-University were of the view that the petitioner-institution did not have adequate infrastructure to run the Course of Diploma in Pharmacy and accordingly, the impugned
order has been passed.
7. This Court is not an expert to form an opinion on the basis of the versions and cross-versions of the respective parties. In view of the above factual aspect of the matter, the matter is remitted to the respondent to pass a fresh order after considering the reply submitted by the petitioner. In case, the respondent-University comes to the conclusion that the deficiencies as pointed out are cured, then appropriate orders be passed allowing the petitioner- institution to participate in the counselling.
8. Needless to observe, the fresh order would be passed by the respondent-University within a period of two weeks.
9. Accordingly, the instant writ petition stands disposed of. Stay application and all pending application(s), if any, also stand
disposed of.
