The writ petition is filed seeking writ of mandamus, praying the following main relief:-
“……declaring inaction of the 3rd respondent in not reinducting the petitioner into 3rd respondent Soecity as illegal, unjustifiable and violative of Article 14, 16 & 21 of Constitution of India, contrary to the provisions of the Act No.4 of 2014 dt. 27.06.20.14 and consequently direct the respondents to re-induct the petitioner by continuing him in service upto 60 years of age into the 3rd respondent-Society as per Resolution No.2, Dt: 30.11.2015, passed by the 3rd respondent, along with consequential benefits, in the interest of justice……”

2. The sum and substance in the present lis is that the petitioner is seeking continuation of his service in the respondents Corporation upto the superannuation age of 60 years.
3. When the matter is called, there is no representation for the petitioner.
4. On the other hand, learned Assistant Government Pleader for Cooperation with reference to para No.6 of the counter affidavit filed on behalf of the 5th respondent, submits that the petitioner retired from service on 30.11.2017 on attaining the age of 60 years. He submits that in view of efflux of time, the writ petition becomes infructuous.
5. In view of the stated position and in the absence of representation from the petitioner’s side, this Court is of the view that merely keeping the writ petition pending would serve no useful purpose. Hence, the writ petition is closed.
6. However, this order will not preclude the petitioner from taking recourse to law as permissible, if so advised. There shall be no order as to costs. As a sequel, all pending applications shall stand closed.
