Heard learned counsel representing the petitioners and
learned counsel representing the respondents.

It is the case of the petitioners that these petitioners who are the retired Drivers, Helper, Electrician and their legal heirs, have not been paid the amount deducted towards Family Pension Head and Provident Fund Head, which they are entitled to receive. The petitioners also claim interest.

Learned counsel representing the respondent – Bihar State Road Transport Corporation (BSRTC), submits that if the

petitioners file their respective representation, the same will be considered and if any amount is found due, the same will be disbursed to them.

Considering the aforesaid submission, I direct the petitioners to file their respective representation annexing all the documents, before the respondent No.3- The Administrator, Bihar State Road Transport Corporation, within four weeks.

On receipt of such representation, the respondent No.3 is
directed to consider the representations of the petitioners and pass an appropriate order, within six weeks.

If the petitioners are found entitled for their claim, the same should be paid to them within two weeks thereafter. The amount will carry interest @ 7 % per annum, which should be calculated from two months after their date of retirement, till the actual amount is paid.

If any part of the claim / representation is rejected for any reason, a detailed speaking order should be communicated to the petitioners.

With the aforesaid directions, this writ petition stands
disposed of.
