As per the averments made in the writ petition, the father of the petitioner was appointed as Class-IV employee on 07.09.1996 by the fourth- respondent and he continued in the Institution till his demise i.e. 10.12.2006 and after that the fourth-respondent has permitted the petitioner to work as Class-IV employee in the Institution from 01.07.2009 and accordingly he is discharging his duties to the utmost satisfaction of respondent Nos.3 and 4. 2. Further, he requested for issuance of appointment letter and in fact salaries were also released in favour of the petitioner by respondent no.3-Institution. 3. During the lockdown period and due to pandemic the petitioner was not permitted to attend the Institution and accordingly they have stopped the payment from 09.04.2020 after Covid. In view of the said circumstances, the petitioner has submitted his representation on 16.04.2020 to the respondent nos.2 and 4 and in fact after pandemic he also sent reminders to the respondent no.2 vide representation dated 06.10.2020, despite the same the respondents have not passed any orders and not permitted to discharge his duties, hence the present writ petition is filed. 4. Despite service the respondent nos.3 and 4 have not chosen to appear before this Court, the respondents no.1 and 2 have also not filed any counter affidavit. 5. In the said circumstances, considering the submissions made by learned counsel for the petitioner and also on perusal of the averments made in the writ petition, as the issue is pending before the respondent no.2, accordingly, the present writ petition is disposed of with a direction to the Versus Counsel for Petitioner(s) : Azizur Rahman Khan, Hitesh Pachori Counsel for Respondent(s) : G.A. Avanish Kumar .....Petitioner(s) State Of U P And 3 Others .....Respondent(s) respondent no.2 to consider the representation made by the petitioner on 06.10.2020 and pass appropriate orders after getting the entire record from respondent nos.3 and 4.
