N SUBBA RAO The Court made the following: 2 HON’BLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION No.35726 OF 2017 ORDER: This instant writ petition is filed by the petitioner seeking the following main prayer:- “to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus (i) declaring the action of the respondents in contemplating to retire the petitioner on attaining 60 years of age, though the age of superannuation fixed as per All India council for Technical Education (Pay Scales, Service conditions and qualifications for the Teachers and other academic staff in Technical Institutions (Degree) Regulations 2010 and guidelines of AP Admission and Fee Regulatory Committee (AFRC) is 65 years for teaching staff, as illegal, irregular, arbitrary, discrimination, un-constitutional and violative of fundamental rights guaranteed under Articles 14 and 16 of Constitution of India; (ii) declare that the petitioner is entitled to continue until attainment of age of 65 years as per All India council for Technical Education (Pay Scales Service conditions and qualifications for the Teachers and other academic staff in Technical Institutions Degree Regulations 2010 and guidelines of AP Admission and Fee Regulatory Committee (AFRC); (iii) consequently declare that the intimation letter Ref:BEC/PF/738 dated 1.8.2017 issued by the respondent 3 No.5 and 6 intimating that the petitioner would be retired from service on 31.10.2017 on completion of 60 years of age; (iv) consequently direct the Respondents 1 to 4 to direct the respondents No.5 and 6 to continue the Petitioner in service as Associate Professor in 6th Respondent Institution till he attain the age of 65 years as per the above mentioned regulations; (v) and to pass such other order or orders….” 2. When the matter came up for hearing, learned counsel for the petitioner reported that in view of subsequent events in the lis, the present writ petition becomes infructuous and no further orders are required. 3. The said submission is recorded. 4. Accordingly, the writ petition is dismissed as infructuous. There shall be no order as to costs.
