The brief facts which are culminated in the filing of these writ petitions are set out below: 2.1. It is the case of the petitioners that the petitioners had joined service as Conductors and were regularized and retired from their service on attaining age of superannuation. In W.P.No.14774 of 2025, the respondents settled the petitioner’s Provident Fund, Earned leave salary, Gratuity Amount and Pension Commutation Amount with a delay of 649 days. In W.P.No.14777 of 2025, the respondents settled the petitioner’s Provident Fund, Earned leave salary, https://www.mhc.tn.gov.in/judis WP No. 14774 of 2025 __________ Page4 of 6 Gratuity Amount with a delay of 654 days. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioners made a representation to the respondents to pay the interest at the rate of 8% p.a., for the belated payment of the petitioners Provident Fund, Earned Leave Salary, Gratuity Amount and Pension Commutation Amount. Since there is no response, the petitioners are before this Court. 3. Heard the learned Counsel on either side and perused the materials available on records. 4. Admittedly, the Provident Fund, Earned Leave Salary, Gratuity Amount and Pension Commutation Amount has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petitions are allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Provident Fund, Earned Leave Salary, Gratuity Amount and Pension Commutation Amount within a period of one (1) month from the date of receipt of a copy of this order. Connected miscellaneous petitions are closed.
