ORAL ORDER
Aggrieved by the order passed in M.C.No.4610/2015 dated 18.09.2025 by the Principal Judge, Family Court, Bangalore, whereby the Family Court had directed the wife to file the statement of Assets and Liabilities, the wife is before this Court.
2. The respondent/husband has appeared as party-in- person.
3. The husband had filed two writ petitions before this Court i.e., WP.No.50738/2019 and WP.No.21516/2021, this Court has disposed of those two writ petitions by order dated 17.07.2025 directing the Family Court to dispose of the pending MC.No.4610/2015 by 15.12.2025, which reads as thus:
ORDER i. The Principal Judge, Family Court, Bengaluru, shall dispose of M.C.No.4610/2015 by 15.12.2025. ii. The Family Court shall fix a timeframe. None of the parties shall ask for

unnecessary adjournments and the Family Court without granting adjournments shall dispose of the case. iii. Both the parties shall file their respective statement of assets and liabilities within 15 days from the date of receipt of copy of the
order. iv. As per the interim order granted by this Court on 30.11.2021, the petitioner/husband shall continue to pay the maintenance of an amount of Rs.7,500/- per month to the respondent/wife till the disposal of the main M.C. v. Accordingly, both the writ petitions are
disposed of. vi. All I.As., in both the writ petitions shall stand closed. 4. Learned counsel appearing for the petitioner/wife submits that the MC is filed seeking divorce. The wife does not require any alimony from the husband and also she do not want any maintenance for the child. It is submitted that the purpose of filing the statement of assets and liabilities is to determine the maintenance and the alimony that is payable to the wife. When the wife is not asking for any of them, there is no necessity to file the statement of assets and liabilities. It is submitted by the learned counsel that in view of the differences between the parties for the last 10 years, if she files the

statement of assets and liabilities, the wife is apprehending that the husband may cause inconvenience to her by coming to the new property which she has purchased. It is submitted that the maintenance that is granted by the Family Court is much before the judgment of the Hon'ble Apex Court in the case of Rajnesh Vs Neha1. 5. The party-in-person submits that she has suppressed several facts. He has filed the statement of assets and liabilities. Unless and until the wife files the statement of assets and liabilities, he would not be able to cross-examine the wife. He has been paying the maintenance for the last 10 years. He has not even been able to see the child till now. If the statement of assets and liabilities are filed, the suppression as well as the misrepresentation of the wife will come on record. It is submitted that though the visitation is granted to the father, in spite of his best effort, he could not see the child for the last 10 years. It is submitted that as per the order of this Court, when the wife is insisting the Family Court to dispose of the matter by 15.12.2025, the other limb of the order

regarding filing of the statement of assets and liabilities should also have been complied with by the wife. 6. Having heard the learned counsel appearing for the petitioner and the party-in-person, perused the material on record.
The Hon'ble Apex Court in the case of Rajnesh Vs. Neha has laid down the guidelines. The whole purpose of filing the statement of assets and liabilities is to place all the record before the Court and to determine the maintenance/alimony payable. In this case, no doubt, the maintenance of an amount of Rs.10,000/- granted was before the judgment of the Hon'ble Apex Court. On the last occasion, when the husband was before this Court questioning the maintenance, this Court has
directed both the parties to file the statement of assets and liabilities. Now, it is the case of the wife that she does not want maintenance / permanent alimony for herself and maintenance for the child. This Court in the earlier writ petition has directed the husband to pay the maintenance of an amount of Rs.7,500/- till the disposal of the MC. Considering the circumstance where the wife is not seeking alimony or maintenance, this Court is of the view that the filing of statement of assets and liabilities by the wife is not required

and the husband also need not pay the maintenance. In these circumstances, this Court is passing the following:
ORDER i. The husband need not pay any maintenance to the wife from 28.10.2025 as per the order dated
17.07.2025. ii. The Family Court is directed to dispose of the matter as per the timeline fixed by this Court in WP.No.50738/2019 and WP.No.21516/2021 dated 17.07.2025. iii. Accordingly, the writ petition is disposed of. iv. All I.As pending shall stand closed.
