This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 658/2024 registered at Police Station – Vidhansabha, Raipur, District Raipur, (C.G.) for the offence punishable under Sections 127(1), 296, 115(2), 351(2), 191(2), 191(3) and 117(4) of the Bharatiya Nyaya Sanhita, 2023.

2 on 30.10.2024, he was sitting near Sheetlana Temple at night with his companions Anshu Verma, Sameer Yadu, and Ram Sahu. From there, they all left for their respective homes. At around 10:30 PM, when he reached near Kapil Kirana Store in Gram Tekari near the Secretariat, Shubham Rajput, Pritam, and Gaurav came and blocked his way. They asked him why he had stopped Shreyansh’s vehicle on 29.10.2024, abusing him with obscene language. They also threatened to kill him and then Gaurav attacked him with a stick. When he tried to escape to save his life, the three accused caught him near Kapil Kirana Store. At that time, other accompanies of the accused—Om Sharma, Rishabh Verma, and Shreyansh—also assaulted him. During the assault, Pritam hit him with an iron pipe, Shubham Rajput struck him on the head with a key, and their other accomplices beat him with hands and fists. Thereafter, crime was registered against the present applicant and the other co-accused persons.

Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated in this case. He also submits that the present applicant is 18 years old student and also states that he has not caused any injury to the injured as the same was caused by co-accused persons, namely, Pritam and Rishabh Verma, who have been arrested and further he has no criminal antecedents, therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, the learned State counsel opposes the bail application of the applicant and submits that the present applicant
3 and other co-accused persons have assaulted the injured by which he received various injuries, therefore, he is not entitled to grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, submissions of learned counsel for the parties, nature of dispute, and material available in the case diary, it appears that the present applicant is 18 years old student and he has not caused any injury to the injured as the same was caused by co-accused persons, namely, Pritam and Rishabh Verma, who have been arrested and further he has no criminal antecedents, therefore, without further consideration on merits, I am inclined to grant anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant - Shreyansh Kurre, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting OfÏcer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till
4 disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
