Ms. Saba Ali, learned counsel appearing for the appellant, on instruction, submits that the application under Section 13(B) of the Hindu Marriage Act has been filed in view of the settlement arrived at as per the mediation as has been conducted in pursuance to the order dated 17.07.2025 passed by this Court, as available in Flag ‘M’, for ready reference, the terms and conditions of the settlement are being referred herein:- (1) That both the parties have amicably settled their dispute. The appellant is ready to pay a lump sum of Rs. 9,50,000/- (Rs. Nine lacs Fifty thousand) to the respondent and the respondent agreed to receive a lump sum of Rs. 9,50,000/- (Rs. Nine Lacs Fifty Thousand) towards one time full and final settlement.

(II) That the above mentioned Rs. 9,50,000/- (Rs. Nine Lacs Fifty Thousand) will be in four installments as under: a. Rs. 2,00,000/- (Rs. Two Lakhs only) in being paid today i.e. on 18.09.2025 by way of two Demand Drafts of Rs. 1,00,000/-each being D.D. Nos. 701926 & 701929 dated 15.09.2025 & 17.09.2025 respectively in favour of respondent namely Priya Agarwal (Priya Devi Chirania) b. The second installment of Rs. 1,50,000/- (Rs. One Lakhs & Fifty Thousand only) will be paid by the appellant to the respondent on or before 18.10.2025 at the time of filing Mutual Divorce (U/S 138 of Hindu Marriage Act) before the leared Family Court, Rajmahal. c. The third installment of Rs. 2,00,000/- (Rs. Two Lakhs only) will be paid by the appellant to the respondent on or before 18.11.2025 at the time of withdrawal of Asansol P.S. Case No. 73 of 2015 pending before the court of learned Judicial Magistrate, Asanol and the Maintenance Case pending before Family Court, Asansol. d. The fourth and final installment of Rs. 4,00,000/- (Rs. Four Lakhs only) will be paid on the second motion of divorce case.
(III) Both the parties agreed to withdraw the cases and counter cases, if any, pending before the competent court of law. (IV) That in future respondent will not claim any maintenance or any claim against the appellant. (V) That both parties will not file any case against each other in future.

Learned counsel appearing for the appellant- husband has submitted that the respondent-wife has also put her appearance.

Learned counsel appearing for the appellant in the aforesaid pretext does not intend to press this appeal.
4. Accordingly, the instant appeal stands
disposed of.
