It is informed that present appeal has wrongly been filed under Section 173 of Motor Vehicles Act, 1988, whereas, in the present controversy, an appeal is required to be filed under Section 30 of the Employees Compensation Act, 1923. 2. Learned counsel for the appellant submitted that present appeal may be dismissed as withdrawn with liberty to file appeal under Section 30 of the Employees Compensation Act, 1923. 3. Accordingly, appeal is dismissed as withdrawn with aforesaid liberty. 4. Office is directed to return the certified copy of impugned order after keeping the same on record. 5.
