The learned counsel for the petitioner submits that after the revision petition was filed not on one date of hearing the petitioner was absent. However, on one fine day, the revision petition is dismissed for non-prosecution. The learned counsel for the petitioner therefore, submits that the matter may be restored while directing the Deputy Commissioner to consider the matter on merits. 4. The submission of the learned counsel for the petitioner is accepted. 5. The writ petition is accordingly disposed of while restoring R.P.No.329/2011 on the file of the 2nd respondent - Deputy Commissioner, Bangalore Urban District with a direction to the Deputy Commissioner to issue notice to the respondents therein, and thereafter, proceed to hear the matter on merits.
