A S C BOSE (SC FOR MUNICIPAL CORPORATIONS AP) The Court made the following: 2 ORDER : This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “.... to issue a Writ, order or direction and more particularly one in the nature of writ of Mandamus declaring the action of the 1st Respondent in granting permission to the 4th Respondent for setting up of an autorickshaw stand and parking of autorickshaws in front of the 1st petitioner’s Mall vide Rc.G1/163030/2010 dated 19.11.2015 as illegal, arbitrary, unconstitutional apart from being in violation of the provisions of the A.P. Motor Vehicles Rules, 1989 and in contravention of the permissions granted by Respondent Nos.1 and 4 and set aside the same and direct the 1st Respondent to take appropriate and necessary steps for the removal of the autorickshaw Stand/autorickshaws from the entrance of the 1st petitioner’s Mall…...” 2. Today, when the matter came up for hearing, learned Standing Counsel representing the 1st respondent-Commissioner stated that at present, auto stand is allowed only on the road margin, which is no way concerned with the petitioner’s Mall, and as of now the petitioners do not have any objection as there are no structures so as to obstruct the flow of traffic in the said area. Therefore, requests this Court to close the writ petition. 3. Recording the same, the Writ Petition is closed. There shall be no order as to costs.
