The petitioner has been made accused in connection with POCSO Case No.92 of 2024 arising out of Mohammadganj P.S. Case No. 47 of 2024, for the offences registered under Sections 137 and 96 of the B.N.S., 2023, and charge has been framed under Sections 137(2), 65(1) and 87 of the B.N.S. and Section 6 of the POCSO Act, pending in the court of learned Exclusive Special Judge, POCSO Court, Palamau at Daltonganj. Petitioner is alleged to have enticed away the daughter of the informant to leave her lawful guardianship with an intention to marry her. Statement of the victim was recorded under Section 183 of the B.N.S.S. in which, she has stated that she was having affair with the petitioner and she has left her lawful guardianship according to her own wish. She has also stated that she wants to marry the petitioner. It was submitted that age of the victim has opined to be about 17 years. This appears to be a case of adolescent love affair between the parties. In view of the submissions made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Exclusive Special Judge, POCSO Court, Palamau at Daltonganj, in connection with POCSO Case No.92 of 2024 arising out of Mohammadganj P.S.
