No.13636 of 2025 Heard Mr. Ashok Kumar, learned counsel for the appellant and learned A.P.P. This application has been preferred by the appellant for condoning a delay of 18 days in preferring the appeal. Having been satisfied with the reasons assigned in the instant application, the same is allowed and the delay of 18 days in filing the appeal is hereby condoned. I.A. No.13636 of 2025 stands disposed of. Cr. Appeal (DB) No. 1313 of 2025 This appeal is directed against the order dated 29.07.2025 passed in B.P. No. 312 of 2025 in connection with Herhanj P.S. Case No. 41 of 2024 by the learned Additional Sessions Judge-I, Latehar whereby and whereunder the prayer for bail of the appellant has been rejected. There was an exchange of firing between the extremists and the police personnel and being outmaneuvered the extremists had fled away. On search of the place of occurrence, several arms and ammunitions were recovered. Submission has been advanced by learned counsel for the appellant that he has been implicated on the confessional statement of the apprehended accused Ajay Kumar and Upendra Yadav. Learned counsel submits that both the said co-accused persons have already been granted bail by a Coordinate Bench of this Court in Cr. Appeal (DB) No.175 of 2025 and Cr. Appeal (DB) No.334 of 2025. It has been submitted that the appellant is in custody since 23.06.2025. 2 Learned A.P.P. though has opposed the prayer for bail of the appellant, but has not disputed the aforesaid fact. Regard being had to the manner of implication of the appellant and the fact that some of the co-accused persons have been granted bail by a Coordinate Bench of this Court, as noted above, we while setting aside the order dated 29.07.2025 passed in B.P. No. 312 of 2025 in connection with Herhanj P.S. Case No. 41 of 2024 by the learned Additional Sessions Judge-I, Latehar, direct the appellant to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Herhanj P.S.
