shop no.21 along with other F.P. Shops of Yerraguntla Village, Sirvella Mandal, Kurnool District, AP and creating one additional Fair Price Shop No.43 at Yerraguntla Village, Sirvella Mandal, Kurnool District as being arbitrary, illegal and also in violation of principles of natural justice besides being violative of Art.14,19(1)(g) and 21 of the Constitution of India and consequently to set aside the proceedings vide Rc.CS3.105/2018 Dt.23- 08- 2018 and to pass IA NO: 1 OF 2018 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased IA NO: 2 OF 2018 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to vacate the interim orders dated 01.11.2018 made in WP.No. 39152/2018 and pass Counsel for the Petitioner:

The Court made the following Order:
The present Writ Petition was filed under Article 226 of the Constitution of India seeking the following relief:-
“… to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the 3rd respondent vide Rc.CS3.105/2018 Dt.23.08.2018 in proposing to bifurcate the petitioner’s fair price shop no.21 along with other F.P.Shops of Yerraguntla Village, Sirvella Mandal, Kurnool District, AP and creating one additional Fair Price Shop No.43 at Yerraguntla Village, Sirvella Mandal, Kurnool District, as being, arbitrary, illegal and also in violation of principles of natural justice besides being violative of Art 14, 19(1)(g) and 21 of the Constitution of India and consequently to set aside the proceedings vide Rc.CS3.105/2018 Dt.23.08.2018 and to pass such other order or orders ….”
2. When the writ petition came up for admission on 01.11.2018, this Court was pleased to pass the following interim order:
“In the meantime, if the written examination is held, respondents are directed not to announce the result of selection of dealership of shop No.43, Yerraguntla Village, Sirivella Mandal, Kurnool District.”

Today when the matter came up for hearing, learned Assistant Government Pleader furnished a copy of the instructions of the Revenue Divisional Officer, vide Rc.B.1255/2025 dated 29.08.2025, wherein, it is stated that no bifurcation has been made for the petitioner’s fair price shop in question. There are only 41 number of fair price shops in Sirivella Mandal and there is no shop No.43 in Sirivella Mandal. During the proposal stage the petitioner approached this Court, wherein, this Court granted status quo and the process was stopped by the then Revenue Divisional Officer, Nandyal. Thereafter, there are no proposals for any bifurcation. 4
4. Recording the same, the Writ Petition is closed. However, the petitioner is at liberty to challenge, if any further bifurcation would be made by the respondents. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed __________________ JUSTICE V.SUJATHA
