GP FOR HOME 2 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a writ order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents 3 and 4 in not initiating action on the petitioners complaint dated 18.12.2024 sent through registered post on 26.12.2024 in exercise of Section 173 of Bharatiya Nagrik Suraksha Sanhita as illegal violative of Articles 14 and 21 of the Constitution of India and contrary to the provisions of the BNSS and consequently direct the respondents 2 to 4 to take action against the 5th respondent who committed dereliction of duties by violating the judgment of the Honble Supreme Court in Lalitha Kumaris and also to initiate action against the 6th respondent who acted in bias.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home would submit that the complaint filed by the petitioner has not been registered as a case against the unofficial respondent, as it is a matter of civil nature. Further, it is submitted that two criminal cases have been registered against the petitioner. 3. For ready reference, the written instructions are extracted hereunder: “It is submitted that, the petitioner sent a representation to the 5th respondent i.e., Station House Officer, Darsi Town Police Station, Prakasam, District on dt.18.12.2024 through registered. Basing on the contents of the complaint, the 5th Respondent called the both parties for preliminary enquiry, on enquiry it is came to light that, the petitioner and 3rd party having civil disputes. As the matter is purely related to the civil issues. The respondent police never interfere with the civil matter prejudice. It is further submitted that, the petitioner is petitionermonger and he also put a petitions to the higher authorities against the previous SI’s of Darsi PS.” 3 4. In that view, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out his remedies before appropriate forum in accordance with law. There shall be no order as to costs.
