Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act. 3 . It is alleged that 160 liters of desir mahua liquor was recovered from forest area . 4. It is submitted that the petitioner is innocent and has falsely been implicated in this case . The name of petitioner transpired on the disclosure of local choukidar. The alleged recovery of illicit liquor has been made from an open place . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner has got 1 criminal antecedent of Patna High Court CR. MISC. No.27449 of 2025(2) dt.15-07-2025 2/2 similar nature in which he is on bail. 5 . Learned counsel for the State opposes the bail petition . 6. Considering the facts of the case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Exclusive special Excise Court - I Banka in connection with Belhar Police Station Case No. 367 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
