Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R Case No.799 of 2023 pending in the file of learned S.D.J.M, Dhenkanal arising out of Dhenkanal Town P.S. Case No.372 of 2023 on the grounds stated. 3. Perused the FIR as at Annexure-1. A copy of the preliminary chargesheet is at Annexure-2. The accused persons have been chargesheeted and claimed to be on bail. A copy of the bail order dated 2nd August, 2023 in ABLAPL No.5805 of 2023 in respect of RI alleged to be involved is produced at the time of hearing. The other bail orders are at Flag-A1 to A4 and the same are perused. Recorded the objection of the State and since the petitioner has not been chargesheeted, whereas, other p. 2 officials implicated revealed from the preliminary chargesheet at Annexure-2 with the investigation kept open in term of Section 173(8) Cr.P.C., having regard to the fact that the co- accused persons are on bail and objection of the State, the Court is inclined to direct release of the petitioner in the event of surrender before the learned court below with conditions imposed. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned S.D.J.M, Dhenkanal within a fortnight from today, it is directed that he shall be released on bail in connection with G.R Case No.799 of 2023 corresponding to Dhenkanal Town P.S. Case No.372 of 2023 on furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed by the court concerned as deemed just and proper and in the facts and circumstances of the case besides the following, such as, he shall cooperate the I.O in the further investigation pending at present without default. 6.
