This is the first bail application filed u/s 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 123/2024 registered at Police Outpost – Uparkachhar, PS Tapkara, District Jashpur (CG) for the offence punishable under Sections 103(1), 238(A), 3(5) of BNS. 2. As per the prosecution case, the applicant is alleged to have assaulted the deceased Bhushan Tirkey with hands, fists, kicks and a stick resulting in his death. 2 to screen from the offence, he stuffed the body in a plastic sack and threw it in Gaibeda dam of Purushottam. 3. Learned counsel appearing for applicant submits that the applicant is innocent and he has been falsely implicated in this case as there is no direct evidence against him. He further submits that there are total 18 witnesses out of which only 6 witnesses have been examined till date, the applicant is in jail since 20.12.2024 and there is no likelihood of the trial to be concluded at the earliest. Therefore, considering all these facts, the applicant may be released on bail. 4. State counsel, on the other hand, opposing the bail application submits that it is a case of circumstantial evidence, there was a quarrel between the applicant and the deceased over a pen drive and the applicant assaulted the deceased with the handle of an axe resulting in his death. Therefore, considering the nature of offence, the applicant does not deserve to be released on bail. 5. Heard learned counsel for the parties and perused the case diary. 6.
Taking into consideration the entire facts and circumstances of the case, particularly the nature and gravity of offence and the material collected and available on record against the applicant, this Court is not inclined to release the applicant on bail. 7. Accordingly, the present bail application stands rejected. 8. However, the Trial Court is directed to expedite the trial and to ensure that the trial is concluded as expeditiously as possible. 9.
