Order On Board 8/9/2025
1. This petition is filed by victim/petitioner seeking cancellation of bail granted to respondent No.2 vide order dated 4.8.2021 passed in M.Cr.C. No.827/2021. 2. Learned counsel for petitioner would submit that after release on bail, respondent No.2 is threatening petitioner and also trying to influence police officials, who are witness to criminal SYED ROSHAN ZAMIR ALI Digitally signed by SYED ROSHAN ZAMIR ALI
2 case. She also contended that in support she has placed on record copy of whats’ app chats as Annexure A-2. 3. Learned counsel for respondent No.2 submits that absolutely false allegation have been levelled in this petition. Some of the grounds raised in this petition would show that this petition is filed in the form of seeking review of the order granting bail. Copy of whats’ app chats, which are enclosed with this petition, prima facie appears to be of prior date from the date of release of respondent No.2 on bail. Respondent No.2 was released on bail on 4.8.2021, whereas it is appearing from the chats that the same pertain to month of May, 2021 i.e. prior to release of respondent No.2 on bail. Petitioner is a central government employee working in Information and Broadcasting Department, however, she has not placed on record copy of any complaint made to police officials with respect to allegations levelled in petition that respondent No.2 is giving threats to her. 4. Learned State Counsel also submits that there is no merit in this petition seeking cancellation of bail. 5. Heard learned counsel for respective parties and perused the documents. 6. Along with this petition seeking cancellation of bail, petitioner has not filed any copy of report/complaint made to the police complaining about threat, if any, given by respondent No.2 to
3 her.
Perusal of whats’ app chats, which are filed as supporting document, does not show that in any of whats’ app chats threat is being given to petitioner after the date of order granting bail to respondent No.2 i.e. 4.8.2021. 7. The law relating to cancellation of bail is clear that it can be cancelled only when it is obtained by suppressing material fact from the Court or any of the conditions of bail order is violated. Petitioner failed to demonstrate any of the above circumstance. Hence, this Court does not find any substance in this petition to grant relief of cancellation of bail, the petition is liable to be and is hereby dismissed. No order as to costs.
