2. Manohari W/o Nathuaran, R/o Jhareda, Hindon Sadar, Karauli, Rajasthan. ----Respondents For Petitioner(s) : Mr. Shivraj Chauhan For Respondent(s) : Mr. Naresh Gupta, PP HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Order 07/10/2025 This criminal petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 (for short, ‘BNSS, 2023’) has been filed for quashing the FIR No.0296 dated 11.07.2025 registered at Police Station Hindon Sadar, District Karauli under Sections 115(2), 126(2), 189(2), 352 and 332(c) of BNS, 2023. Contention of the learned counsel for the petitioners is that the subject FIR was lodged as a counter blast to the FIR No.0295 even dated lodged by Shri Dhandoli, husband of the petitioner no.1 and father of the petitioner no.3. He further submits that, as a matter of fact, no such incident, as alleged in the FIR, has taken place. He, therefore, prays that the criminal misc. petition be allowed and the subject FIR be quashed and set aside.
[2025:RJ-JP:40698] (2 of 2) [CRLMP-6443/2025] Per contra, learned Public Prosecutor opposes the prayer. Heard. Considered. Indisputably, the contents of the subject FIR disclose commission of cognizable offence against the petitioners. A comparison of the subject FIR and the FIR lodged at behest of the petitioner side reveals that the incidents, though of even date, are alleged to have occurred at different places at different point of time. Merely because the FIR lodged on behalf of the petitioner side is prior in time, looking to the short time span within which the subject FIR is lodged, it cannot be inferred that it has been lodged as the counter blast. Further, there is no material available on record to warrant a finding that the allegations levelled in the subject FIR are false and no such incident has occurred. In view of the aforesaid, this Court finds no merit in the criminal misc. petition which is dismissed accordingly. Pending application(s), if any, also stands disposed of accordingly.
