1. Heard Mrs. Yuktha N., learned counsel for the petitioner and Smt. Haleema Ameen, learned counsel for the respondent.
2. Present petition is filed under Section 24 of of the Code of Civil Procedure Code filed by the wife with the following prayer: WHEREFORE, it is humbly prayed that this Hon'ble Court may kindly be pleased to : (a) Pass an order transferring the case, now pending in M.C.No.198/2025 pending on the file of the Principal Judge, Family Court, Ballari to the Family Court at Bengaluru, for disposal in accordance with law, in the interest of justice and equity."

Facts in the nutshell which are utmost necessary for disposal of the present petition are as under: 4.1 On account of the strained matrimonial relationship between the parties, the respondent/husband has filed petition under Section 9 of the Hindu Marriage Act on the file of Family Court, Ballari.
4. Wife is residing at Bangalore, expresses her inability to attend the Court at Ballari on account of geographical distance as well as financial incapacity to effectively participate in the said matrimonial proceedings.
5. Grounds of revision is opposed by Smt. Haleema, learned counsel for the respondent/husband.
6. Having heard the arguments of both sides this Court perused the material on record meticulously.

7. On such perusal of the material on record, admittedly the case is one for restoration of conjugal rights.
8. This Court secured the presence of the parties and the husband is prepared to adhere to all the conditions that were sought to be imposed by the wife to arrive at a amicable settlement.
9. Despite such arrangements, such conditions being accepted by the husband, petitioner wife is not willing to join the husband. Therefore, the petition for restoration of conjugal rights needs to be adjudicated on merits.
10. Having noted as above, geographical distance and financial incapacity are no longer valid parameters for transfer of a case from one Court to another Court in view of the video conferencing facilities.
11. If the petitioner/wife files an application before the Court at Ballari to effectively participate in the pending

HC-KAR NC: 2025:KHC:52574 CP No. 352 of 2025 matrimonial proceedings through video conferencing, the learned Judge at Ballari shall permit the wife to appear through video conferencing.
12. With that direction, following order:
