THE HONOURABLE SMT JUSTICE V.SUJATHA Writ Petition No: 38814 of 2018 ORDER:
The present writ petition is filed to declare the action of the respondent Nos.3 to 5 in seizure of 16,800 kgs of rice through the Seizure Panchanama, dated 29.09.2018, on the ground that the petitioner has purchased the same from the cardholders, as illegal.
2. When this writ petition came up for admission on 29.10.2018, this Court passed the following order:
“Pending disposal of the writ petition, respondents are directed to release the goods seized under cover of panchanama dated 29.09.2018 to the petitioners subject to petitioners furnishing personal bond equivalent to the value of the goods sized.”
3. Today, when the matter came up for hearing, learned Assistant Government Pleader for Civil Supplies has furnished a copy of the receipt dated 19.11.2018, according to which the seized rice was handed over to the petitioner without even obtaining personal bond from the petitioner, which was also endorsed by the petitioner on the same day admitting the same.
4. In view of the same, this Court is of the opinion that no further cause survives and the writ petition is accordingly dismissed as infructuous. No order as to costs. Pending miscellaneous applications, if any, in this petition, shall stand closed.
